I've received a discrimination claim, what do I do?
Overview of situation
An employee of ours claimed that they had been discriminated against on the grounds of sex following a promotion of another team member.

The problem faced
The employee raised a damaging and time-consuming Grievance based on the grounds of sex discrimination. Equally, it also caused a rift within the department that affected multiple other staff members. We also couldn’t make the operational adjustments that we wanted to which were the driving factors behind the promotion in the first place.

What caused the problem
The cause of our problem was the fact that we didn’t offer the promotional opportunity to the other colleague i.e. hold in internal process. We decided as a management team who the best person was based on performance only.

Cost of the opportunity
It was multifaceted – the cost of the grievance to the managers and employees involved and dealing with it. The emotional strain that it took on the team and loss of morale and team cohesion that we had worked so hard to build. The tens of thousands lost in opportunity that the operational change would have created. Also, noticeable damage to existing clients through our inability to efficiently service, bore out of the bottle neck of work this problem created.

The plan XYZ proposed
Immediately Bearman HR took the brief from our management team and the employee and went to work. We didn’t have a formalised Grievance process and Bearman HR was able to create one ‘on the job’ which was a god send and gave us instant relief. They also created and internal recruitment process which included an impartial job assessment tool (to avoid discrimination). Lastly, Bearman HR also carried our line manager training to ensure full understanding of the process (and pitfalls) to avoid this happening again to us.

Results that followed
Bearman HR concluded the grievance to the satisfaction of all parties concerned. They also mediated between the management team and complaining employee so we had a cohesive team back. Resultingly, the bottle neck of work instantly alleviated and our service to clients increased therefore meaning our growth rates started to increase again. Moving forward we are now looking to internally promote again, this time with the support of Bearman HR and their proactive people management style.
